Products Liability

According to the Consumer Product Safety Commission, there are approximately 22,000 deaths and 29 million people injured due to unsafe products each year. Every consumer has the right to be protected from negligently designed, manufactured and mislabeled products.

We are currently helping clients with the following Drug and Device recalls:

Medtronic Sprint Fidelis Defibrillator Leads RECALL

Medtronic Neuromodulation SynchroMed Pump Recall

Digitek or Digoxin Tablet Recall

An injury on the job in which a workers’ compensation claim is brought may be the result of an unsafe product. When that happens the injured worker may have claims for pain and suffering against the manufacturer of the product that he or she cannot recover for through the workers’ compensation system. Although we hope all of our client’s work in safe environments, sometimes through no fault of the employer ladders, saws and other important equipment are poorly or negligently designed resulting in injuries to hardworking employees. When that happens we will take the correct steps to assist our clients with their recoveries. North Carolina also has a strong Lemon Law protecting consumers against poorly designed or manufactured vehicles. The North Carolina Lemon Law protects the purchaser or a new motor vehicle that has the same problem four (4) or more times or is in the shop twenty (20) days within the first year of purchase. Other new vehicles also fall into the Lemon Law category. Our attorneys have prosecuted numerous claims for victims of poorly manufactured cars helping them to recover the amount of their purchase price, attorney’s fees and costs.

At Keel O’Malley Tunstall L.L.P., we are dedicated to holding the manufacturers of unsafe and defective products liable for their actions. We have helped improve the lives of clients injured by defective products by successfully fighting for fair compensation for their injuries. We have effectively handled product liability cases, including dangerous drugs, contaminated foods, vehicle accidents, unsafe medical and pharmaceutical products, toxic chemicals and other unsafe products for clients throughout North Carolina. We also represent clients in their Medical Malpractice, Personal Injury, Automobile Accidents, Workers’ Compensation, and Social Security Disability claims.

If you believe that you were injured, or that someone you love has died because of a defective product, it is important that you contact an experienced attorney. Timing is critical in these claims due to the Statute of Limitations and Statute of Repose that restricts the time frame in which to file a lawsuit. At Keel O’Malley L.L.P., we believe that consumers have the right to products that are safe when taken as directed. Our team of attorneys, legal assistants, investigators and even a registered nurse will review and analyze your case. We will discuss your case in an initial consultation that is always free.
