Medical Malpractice

The National Academy of Sciences estimates that approximately 98,000 Americans die from "medical mistakes" each year. Not all bad results or deaths are a result of the negligence of a healthcare provider. Quite often, a patient may experience a "bad result" of a surgical procedure that was a known risk of the surgical procedure, and that risk was communicated to and accepted by the patient. In such cases, the bad result will not support a malpractice action against the healthcare provider.

In order for there to be malpractice, the physician (or other healthcare provider) must have deviated from the standard of care for physicians (or other healthcare providers) in the same specialty, within the same or similar communities, during the same time period in which the act occurred.

Investigation and pursuit of a medical malpractice action to trial is extremely expensive. Almost always it is necessary to travel outside the state to locate qualified experts willing to testify.

Nonetheless, cases where an individual may have suffered a catastrophic injury or death as a result of a physician's negligence needs to be investigated. If you or someone you love has suffered such catastrophic injury or if someone you love has died as a result of the negligence of a doctor or other healthcare provider, Keel & O'Malley can help you recover damages for such injuries or death.

Doctors, nurses and other health care providers invest a significant amount of time and energy into learning how to treat illnesses and physical maladies. While most medical professionals are dedicated to helping to improve people's lives, health care providers can also make medical mistakes that cause injury and even death. Because we recognize that medical errors or misdiagnosis can be devastating to victims and their families, the attorneys at Keel O'Malley, L.L.P. has dedicated ourselves to helping improve the lives of our clients by fighting for their right to fair compensation. Simply stated, medical malpractice is negligence and those who are responsible for injury and death are liable for their actions.

Our team of attorneys, legal assistants, a professional investigator and a registered nurse will review and analyze your case. We will discuss the situation with you in an initial consultation that is always free. At Keel O'Malley, L.L.P., we are dedicated to protecting the rights of the victims of medical malpractice and their families. If you or a loved one is in need of legal assistance, call Keel O'Malley, L.L.P. at (252) 823-2266 or toll free (800) 755-1987 or submit an online questionnaire. We will work for you on a contingency fee basis, meaning that we collect attorney's fees only if there is a monetary recovery of funds. In many cases, a lawsuit must be filed before an applicable expiration date, known as a statute of limitations. Please call right away to ensure that you do not waive your right to possible compensation.
