The National Academy of Sciences estimates that
approximately 98,000 Americans die from "medical
mistakes" each year. Not all bad results or deaths
are a result of the negligence of a healthcare
provider. Quite often, a patient may experience a
"bad result" of a surgical procedure that was a
known risk of the surgical procedure, and that risk
was communicated to and accepted by the patient. In
such cases, the bad result will not support a
malpractice action against the healthcare provider.
In order for there to be malpractice, the physician
(or other healthcare provider) must have deviated
from the standard of care for physicians (or other
healthcare providers) in the same specialty, within
the same or similar communities, during the same
time period in which the act occurred.
Investigation and pursuit of a medical malpractice
action to trial is extremely expensive. Almost
always it is necessary to travel outside the state
to locate qualified experts willing to testify.
Nonetheless, cases where an individual may have
suffered a catastrophic injury or death as a result
of a physician's negligence needs to be
investigated. If you or someone you love has
suffered such catastrophic injury or if someone you
love has died as a result of the negligence of a
doctor or other healthcare provider, Keel & O'Malley
can help you recover damages for such injuries or
death.
